What Is CBAM and How Does It Affect Indian Exporters?
The Carbon Border Adjustment Mechanism (CBAM) is the EU's carbon pricing mechanism for imports. It applies to iron and steel, aluminium, cement, fertilisers, electricity, and hydrogen. Since October 2023, importers must report embedded emissions. From January 2026, importers must purchase CBAM certificates corresponding to the carbon price that would have been paid if the goods had been produced under EU carbon pricing rules. Indian exporters of steel, aluminium, and cement must provide verified emissions data to their EU importers.
Does Belgium Charge VAT on Imports?
Yes. Belgium charges 21% VAT (standard rate) on the customs value plus duty. Reduced rates of 6% and 12% apply to certain goods (food, books, medical products). The Belgian importer typically reclaims the import VAT through their periodic VAT return. As an Indian exporter, VAT does not directly affect your pricing, but your buyer will factor it into their cash flow calculations.
What EU and Belgian Compliance Rules Must Indian Exporters Follow?
Belgium follows EU-wide product safety and environmental regulations, which are among the most stringent in the world. Non-compliant goods can be seized at the border, recalled from the market, or result in penalties for both the exporter and the Belgian importer.
4.1 Is CE Marking Mandatory for My Products?
CE marking is mandatory for a wide range of product categories sold in the EU, including machinery, electronics, toys, medical devices, personal protective equipment, construction products, and pressure equipment. The CE mark certifies that your product meets EU safety, health, and environmental requirements.

- Identify applicable EU directives. Determine which EU directives and harmonised standards apply to your product (e.g., Low Voltage Directive for electrical equipment, Machinery Directive for machines).
- Conformity assessment. Conduct testing and assessment per the applicable standards. Some products require third-party (Notified Body) assessment; others allow self-declaration.
- Technical documentation. Prepare and maintain a technical file including design drawings, test reports, risk assessments, and user instructions.
- EU Declaration of Conformity. Sign a formal declaration stating your product complies with all applicable EU requirements. Must include your EU Authorised Representative's details.
- Affix the CE mark. The CE symbol must be visible, legible, and indelible on the product or its packaging (minimum 5mm height).
4.2 What Is REACH and How Does It Affect My Exports?
REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) is the EU's comprehensive chemicals regulation. It applies to chemicals, mixtures, and articles that contain or release certain substances.
- Substances in articles. If your product contains Substances of Very High Concern (SVHCs) above 0.1% w/w, you must notify ECHA and inform your buyer.
- Chemical exports. Chemicals exported to the EU in quantities above 1 tonne/year must be registered with ECHA. Your EU importer (as the "Only Representative") typically handles this.
- Restricted substances. Check the REACH Annex XVII for restricted substances that may affect textiles, leather, plastics, and consumer goods.
- SCIP database. Articles containing SVHCs above 0.1% must be notified to ECHA's SCIP waste database.
4.3 What Are FAVV/AFSCA Requirements for Food Products?
Belgium's Federal Agency for the Safety of the Food Chain (FAVV/AFSCA) regulates food safety and is responsible for border inspections of food products entering Belgium.
- Pre-notification. Food, feed, and animal products must be pre-notified via the EU TRACES system before arrival.
- Health certificates. Required for products of animal origin (fish, dairy, meat). India must be on the EU's approved third-country list for the specific product category.
- Phytosanitary certificates. Required for plant products. Issued by India's NPPO.
- Maximum residue levels (MRLs). The EU has strict MRL limits for pesticides in food products. Indian spices and tea have faced increased scrutiny and rejections due to MRL violations.
- HACCP compliance. Food processing facilities must follow HACCP principles.
4.4 What Labeling Rules Must I Follow for Belgium?
Belgium's labeling requirements follow EU standards but have an important local addition. Belgium is a trilingual country (Dutch, French, German), and labeling requirements vary by region:
- Trilingual labeling. Consumer products sold in Belgium may require labeling in French, Dutch, and German depending on the region of sale. Products distributed nationally should include all three languages.
- Country of origin. "Made in India" must be clearly marked on the product or packaging.
- Food labeling. Must follow EU Regulation 1169/2011 (FIC): ingredient list, allergen declarations, nutrition information, net weight in metric units, and best-before/use-by dates.
- Textile labeling. Fibre composition must be declared per EU Regulation 1007/2011.
- Energy labeling. Electrical appliances must carry the EU energy label (A to G scale).
4.5 What Are EUDR and PPWR?
Two major new EU regulations are coming into effect that will affect Indian exporters:
- EUDR (EU Deforestation Regulation). From August 2026, products linked to deforestation (coffee, cocoa, soy, palm oil, wood, rubber, cattle products) cannot be placed on the EU market unless accompanied by a due diligence statement proving they are deforestation-free. Indian coffee and rubber exporters are directly affected.
- PPWR (Packaging and Packaging Waste Regulation). From August 2026, new packaging sustainability requirements take effect, including minimum recycled content, recyclability criteria, and restrictions on certain packaging formats. Indian exporters must ensure their packaging meets these new standards.
How Does the Antwerp Diamond Trade Work?
Antwerp is the global hub of the diamond trade, handling approximately 80% of the world's rough diamond trade and 50% of polished diamond trade by value. India is the world's largest diamond cutting and polishing centre, making the India-Antwerp diamond corridor one of the most significant bilateral trade flows.
What Is the Antwerp Diamond Office (ADO)?
The Antwerp Diamond Office is the official government body responsible for overseeing diamond imports and exports through Belgium. All diamond shipments entering or leaving Belgium must be processed through the ADO.
Diamond Export Requirements
- Kimberley Process Certificate (KPC). Mandatory for all rough diamond shipments. India's KPC authority is the Gem and Jewellery Export Promotion Council (GJEPC). The certificate must accompany the physical shipment in a tamper-proof container.
- ADO registration. Your Belgian buyer must be registered with the Antwerp Diamond Office. The ADO inspects and verifies all incoming diamond parcels.
- Valuation. The ADO independently values diamond shipments. Declared values that significantly deviate from ADO valuation may trigger investigation.
- Cut and polished diamonds. While KPC certificates are only required for rough diamonds, polished diamonds still require proper commercial documentation and customs declarations through the ADO.
- Duty rate. Cut and polished diamonds enter the EU at 0% duty. Rough diamonds also enter at 0%.
