What Is CBAM and How Does It Affect Indian Exports?

The EU Carbon Border Adjustment Mechanism (CBAM) is a carbon pricing mechanism that applies to imports of iron, steel, aluminium, cement, fertilisers, electricity, and hydrogen. Since October 2023, importers must report the embedded carbon emissions in these products. From January 2026, importers must purchase CBAM certificates corresponding to the EU ETS carbon price. 4.2 What Is REACH and Does It Apply to My Products?

REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) is the EU's chemicals regulation. It applies to virtually every product exported to Spain that contains chemicals. Not just chemical products themselves, but also textiles, leather, plastics, paints, cosmetics, and electronics.

  • Substances exported in quantities above 1 tonne/year must be registered with ECHA (European Chemicals Agency) by your EU-based Only Representative or importer.

  • EU-approved establishment. Your manufacturing facility must be on the EU's list of approved third-country food establishments for products of animal origin (seafood, dairy, meat).
  • HACCP certification. Hazard Analysis and Critical Control Points documentation is mandatory.
  • MRL (Maximum Residue Limits). EU MRLs for pesticides are among the strictest in the world. Indian spices and agricultural products frequently face rejections due to MRL violations at EU borders.
